Anti-Fraud Policy
Gaan Baksho Music’s Account Violation Policy
Gaan Baksho Music will issue up to two warnings to a client before considering the termination of their account. However, in extreme cases involving severe violations or actions that prejudice our business, we may be compelled to terminate an account immediately without prior warning.
The purpose of these warnings is to ensure that any potentially fraudulent or infringing activity by a client or their sub-accounts is thoroughly reviewed and addressed. This approach provides an opportunity for the situation to be rectified. We expect clients to investigate these warnings promptly and take appropriate action to prevent repeated violations by their end users or sub-accounts.
Notification of Violations
Gaan Baksho Music will notify a client of any violations within three business days of the issue being identified or reported to us. Violations may include, but are not limited to:
- Intellectual property or trademark breaches
- Significant instances of artificial streaming
- Violations of any DSPs’ (Digital Service Providers) Terms of Use
- Breaches of YouTube’s monetisation policies
Warning Stages
First Warning
A first warning is issued in cases of repeat violations, such as:
- When the same sub-account is responsible for another violation within 30 days of the initial issue being reported.
- When the same type of violation reoccurs within 30 days of being reported.
Second Warning
A second warning is issued in cases such as:
- Repeated failure to act on end-user violations within reasonable timeframes or specified deadlines.
- Repeated occurrences of the same type of violation.
Account Termination Review
Following a second warning, Gaan Baksho Music will collaborate with the client to develop a corrective action plan, including specific targets, to avoid account termination. However, we reserve the right to revoke access to DSP distribution or terminate the client’s account at our discretion if fraudulent or infringing activity persists. Account termination is considered a last resort but remains at our sole discretion, irrespective of the number of fraud cases linked to the client.
Consequences of Fraudulent Activity
If a client or their end users breach our Terms of Service, Gaan Baksho Music reserves the right to:
- Remove infringing content
- Withhold royalties and place them in escrow
- Suspend access to specific DSPs
- Terminate end-user accounts
- Terminate the client’s account entirely
If fraudulent or infringing activities are determined to be caused by a client or their end users, we reserve the right to close the account and terminate the contractual relationship. Any associated costs, including legal fees, may be deducted from future payments to the client. Additional legal action may also be pursued.
Account Unblocking
If an account is blocked due to suspected violations, Gaan Baksho Music will notify the client via email. The account will remain blocked until the client provides the requested information within four working days. Once the information is verified, the account may be unblocked.
We may request:
- Updated client details
- A copy of a valid identification document (e.g., passport or national ID)
- Verification of artist profiles, including social media links (Twitter, Facebook, Instagram, etc.) and historical data to support sales activity
Blocked Account Policy
If the requested information is not provided within four working days, the account may remain blocked. Royalties associated with the account will be withheld in escrow for up to 24 months, aligning with DSP policies that allow for royalty claims within this timeframe.
Clients with blocked accounts will lose access to all Gaan Baksho Music services, and their content will be removed from DSPs.
Withholding Royalties (Escrow)
Royalties from blocked accounts will be held in escrow for up to 12 months or until claims are resolved. This ensures that funds are available to address the following situations:
- End users prove their accounts are not fraudulent, allowing royalties to be released.
- DSPs request refunds of royalties deemed to have been generated fraudulently.
- Legitimate rights holders claim payouts for withheld royalties linked to unauthorised activity.
This policy ensures that Gaan Baksho Music maintains integrity and compliance within the digital music distribution landscape.
